Appealing a divorce case can be an incredibly daunting task. An attorney since 1968, Brian G. Saylin has devoted his practice to the areas of family law and California Appellate Practice since the late '70s. Certified by the State of California as a specialist in family law, Saylin has also been elected as a Fellow in the American Academy of Matrimonial Lawyers. He has lectured fellow lawyers in the Continuing Education of the Bar in the areas of divorce and appellate practice and has also taught aspiring lawyers at Western State College of Law. In addition, Saylin has been hired to sit as a judge in private litigation proceedings. He has received the highest rating (AV) by Martindale-Hubbell, and he sits on Divorce Magazine's Advisory Board.
With scores of appeals behind him -- including the published decisions in In re Marriage of Koester, In re Marriage of Schaefer, In re Marriage of Dunn, In re Marriage of Henry, and In re Marriage of Reissmueller -- Saylin has represented clients in courts throughout the State of California. "Appeals generally involve only one court appearance, so I'm not limited to Orange County," he points out. Practicing in the lower courts while engaging in the appellate practice has sharpened Saylin’s proficiency in each of these areas. But it's the latter where his passion for law really shines. "More than anything, the appellate practice gives me the ability to make new law and define what the law is," Saylin explains. "Appellate law has the advantage of being a purely intellectual competition, and I really enjoy the challenge." The bulk of his appellate practice is limited to family law. "I know all the cases that come down, so I'm intimately familiar with this area." Saylin, selected as a Super Lawyer for the past three years by SuperLawyers.com, is the attorney other attorneys turn to when they need an assessment of a case -- before, during, or after a trial. "I investigate whether there's a viable appeal," says Saylin. Consulting a certified family-law specialist who limits his appellate practice to the area of family law can benefit a client, even if no appeal is ultimately undertaken. "Instead of charging off into the appellate battlefield, it's important to first examine if it is in the client’s best interest," notes Saylin. "The emotions of a divorce proceeding -- for both client and counsel -- make it difficult to objectively determine if an appellate undertaking is beneficial or merely the prolonging of the agony." He also advises lawyers about the timing of their appeals, investigates alternatives, and considers post-judgment motions. "Timing is crucial: if you don't file in a timely manner, you will lose your right to appeal," he warns. "It's essential to meet the deadlines for your specific case." Saylin is unique in that he combines a heavy family-law practice with a heavy appellate practice. And he doesn’t hand appellate work off to juniors or associates. "I'm a sole practitioner, so I'm the one you see," stresses Saylin. "I'm the one who works on your client's case.
