Title: mortgage vs deed on homes
Married only 3 months now divorcing. Mortgage on my home is in only my name. 2 months after wedding I agreed to put spouse name on deed. Only equity in home is from down payment 1 year prior solely from me and from a reduction in principle 3 prior to wedding solely from me (inheritance). Spouse wants home sold and half of equity. Will this happen?

as long as you can show all of the money came from you then you should be fine. go into the paperwork and find the settlement sheet from when you sold the house, you can then use the settlement sheet from the new purchase to prove the same amt of money was used. it will also show your husband had nothing to do with the old house or the purchase of this house since his name was not on any of the paperwork. they you and also get a copy of the deed to prove that you did put him on. now he may get some type of money if he contributed to the household bills. liek comp for paying the mortgage but he may only get half and that should be for the time he was contributing to the mortgage.

I don't think he can force you to sell your home if the home was purchased prior to your marriage. He will be entitled to 50% of the money paid toward the pinciple on the mortgage during the marriage. If you're married three months and file for divorce, he may be entitled to three months worth of 50% of the money applied toward the principle. See a lawyer.
