A no-fault divorce simply means that you do not have to prove misconduct by your spouse to obtain a divorce. However, that misconduct may still be relevant evidence in your case. Florida’s alimony statute, F.S. 61.08, includes infidelity as a factor; as does Florida’s child custody statute, F.S. 61.13(3) (“moral fitness of the parents”).
