Sometimes divorcing couples are able to agree to a settlement without contentious litigation. While it is often preferable to resolve issues in a divorce with an agreement rather than contentious litigation, that is not the case unless the agreement is fair to you and serves your interests.
Your spouse’s counsel has no duty to look out for you — quite the opposite. Your spouse’s attorney has a duty to only represent your spouse’s interests. You should have an attorney to make sure your rights are protected as well. Given the complexities of a divorce case and the many different legal areas which can be involved, it is better to retain a lawyer sooner rather than later.
