Little known fact: August is National Child Support Awareness Month. It’s a time of year when child support agencies and advocates across the country participate in education and awareness programs about child support – and the consequences of failing to pay it. To mark the occasion, we are getting down to basics and highlighting things parents absolutely should know about failing to pay child support in Texas.
The Consequences of Failing to Pay Child Support in Texas
1. You can go to jail for failing to pay child support in Texas.
Texas does not tolerate child support evaders. Parents who fail or refuse to pay child support can go to jail for up to two years and pay thousands of dollar in fines – on top of the child support they owe.
There are basically two avenues for which you can be sent to jail for failing to pay child support.
- Under Texas law, a judge can find you in contempt of court and place you in jail for up to six months for not following a court order to pay child support.
- You could also be found to be in violation of Texas Penal Code 25.05, which makes it a state jail felony to “intentionally” or “knowingly” fail to provide court-ordered child support for a child under 18. This is often referred to as criminal nonsupport. A state jail felony is punishable by up to six months to two years in a state jail facility and a maximum $10,000 fine.
2. Your license(s) can be revoked or suspended for failing to pay child support.
This includes your driver’s license, business license, commercial driver’s license, concealed handgun license and even a hunting or fishing license. Under Chapter 232 of the Texas Family Code, any license issued by a Texas agency can be revoked or suspended for failure to pay child support.
3. The state can garnish child support wages from your paycheck.
In this day and age, most court orders for child support include an automatic income withholding order (IWO). This order is sent to the non-custodial parent’s employer instructing them to withhold child support payments from the employee’s income. This has become an effective tool for collecting child support.
4. The government can intercept tax refunds and lottery winnings if you are behind in child support.
If a noncustodial parent falls behind in payments, the state can intercept federal income tax refund checks, lottery winnings or any other money from state or federal sources.
5. A lien can be placed on your property if you owe back child support.
“Child support liens” are not uncommon. Liens can be placed against property, cars, bank accounts, retirement plans, and other assets if you are in arrears. The lien will remain in place until the debt is satisfied.
6. You may not be able to get a passport if you owe child support.
If you owe more than $2,500 in child support, you are not eligible to receive a U.S. passport.
7. Owing back child support can negatively impact your credit rating.
The state is authorized to report the names of individuals who are delinquent in child support to consumer credit bureaus.
8. Court-ordered child support does not automatically stop if you are incarcerated.
The state of Texas does not automatically halt or modify child support orders for non-custodial parents who go to jail or prison. In other words, your child support obligation will remain the same and debt will continue to mount while behind bars. To modify child support payments while behind bars, the non-custodial parent must file a “Incarcerated Noncustodial Parent Affidavit of Income/Assets” and show that there has been a “material and substantial change in circumstances.”
9. Past-due child support doesn’t ever go away.
In fact, the amount will just continue to get bigger because the state charges interest on unpaid child support. The state can go after and collect unpaid child support even after the child becomes an adult.
10. You cannot be denied access to your child if you owe child support
In Texas, child support and visitation are completely separate. The custodial parent cannot prohibit you from seeing your child if you owe child support. Likewise, you must pay child support even if don’t see your child.
11. The state has a webpage and a hotline devoted to “Child Support Evaders.”
The Attorney General of Texas has child support evaders webpage that lists the photo and profiles of delinquent parents who are at least $5000 in arrears, exactly how much they owe in child support, how many children they have and a link to report this person if you know them or their whereabouts. For example, one individual “owes $190,956 for the support of 5 children.” The state also has a hotline to report so-called “deadbeat parents.” The number is 1-866-EVADERS.
12. You should always try and pay something.
If you cannot pay the full amount one month, you should at least try and pay something. A partial payment shows that you are at least making an effort. You should also call the child support payment handling your case and explain the situation.

Deborah, why didn’t you mention that Texas is second only to California in back child support owed? Over $16 Billion dollars owed in arrears in Texas, with 48% of female headed fdmilies below the poverty line. Texas needs to step up, not take a bow!

I find this to be completely and utterly ridiculous. Child support is an outdated system that is established based on a 20 minute hearing that doesn’t even examine the each parties financial situation, their individual personalities (i.e. make sure the mother isn’t a textbook narcissist with an agenda), parenting abilities and/or general reasons there should be equal support.
I have the most beautiful little girl in the world and an extremely bitter ex that I’ve known for 15 years who has an annual income of over 200K that continuously prevents my possession, has alienated me since our daughter was born, refuses to abide by our court order AND enforced me for child support when I had a brain tumor that depleted my energy, which caused me to lose my job and incur thousands in debt.
I was stupid to think that my ex would have any sort of empathy when I explained what I was going through. Instead she decided to use this situation to reduce my possession, have my arrears reported on my credit (preventing me from getting a law school student loan OR any credit related item like a credit card) and forcing continuous litigation that I am forced to represent myself against her 2 attorneys.

It is not just Fathers. I have custody of our son and his out of state Mom refuses to pay court ordered support. Not all fathers are deadbeat’s its mothers also. Maybe not as many but the fact still remains that there are more single Fathers who don’t get support than people realize.
Same with my step son! We’ve had him for a year in July 2020 and she’s not paid one dime. She’s from Arkansas and the right now it’s a joke. She’s pregnant with her third child out of wedlock and no clue who the father is (once again). She even claimed my step son on her taxes and we had to fight that too. Thank the lord we got it and his stimulus check. So now she owes the it’s the money she took from them AND over a year in child support. 🤦🏼♀️. She’s a pos and a real deadbeat! No matter what your physical, mental or financial situation is, it still does not change the fact that you have a financial obligation to help support YOUR child! My goodness, it’s not like you have to even share the responsibility equally with the custodial parent! You only have to help out with 20% of your child’s needs! That is more than fair! Think about it this way, what would you do if your child lived with you? You would have to figure out a way to provide for your child or the state would eventually take your child away to ennsure that your child is properly cared for.

If you provided your children with a roof over their heads and food to eat you spent more than 20% on them. Children are money intensive individuals. And they older they get, the more they cost.
All these people claiming the 20 percent rule.. i pay more than 60 percent of my exes total income she works part time and pockets 1200 a month for a grand total of about 2200 a month income.. i however make 3 grand lose 1200 in support and also have children living with me. I have to make ends meet. I dont get a hand out i domt get state benefots. I lose half my net income and get told fogure it out while she receives 1200 tax free and gets state benefits because she only makes about 1100 a month cuzz shes figured out as long as im paying she dont have to work full time
Cindy, the only people who are deabeats are the ones whonare either completely avoiding child support where they can pay something or the ones abusing the system because they dont want to work. Its usually the recipients that are the deadbeats and its usually men that are being abused. A lot of women are either vindictive and abusing the system or lazy and abusing the system. Rarely does the father who has custody bring deadbeat moms who dont pay child support to court for jail and the men who abuse the chidl support and spousal are few in compare to the women. The women who abuse the family system are pretty much worthless and there are a lot of them!

J Cohen, your situation is unfortunate. However, I have 2 children with my ex-husband and he refuses to give me a penny for the girls. Contrary to what another father said in a previous comment children are not cheap. I never gave my ex any grief or hassle about seeing his children. He’s in the arrears over $12,000 now and if it weren’t for child support I wouldn’t have gotten a dime to help provide for my children. So as with anything, child support can be a saving grace, or a nightmare, depending on the person you chose to have a child with. #ijs. The system is definitely flawed —with our children falling through the cracks and victims being revictimized. What I’ve learned and am happy to share, in this long rigorous journey is that i can’t change what the other parent chooses to do, but I can change how I respond. Focusing less on the other parent and more on My choices and what I need to do for my children. It’s not always , not even sometimes, easy. But they’re worth it and more to the point, the only ones entitled to anything.
If you can’t afford to pay for children then don’t make any. It’s that simple.

I never believed in child support I have 2 sons which are now 25 & 31. I left their father when the baby was a couple of months old. I have NEVER filed for child support. I worked 2 jobs to take care of mine never filed gor for child support a day in their life. They are well raised men with families of their own now. Because whats the purpose of putting a man in jail for child suppport they still not paying if they are locked up. Just my opinion, don’t mean to offend anyone.
I work two jobs and my husband that works 0 jobs owes $60,000 in child support. Why is it fair for him to still get access to his son, when I’m working hard to make a life for my kid and he’s doing nothing? He hasn’t even bought him a thread of clothing? Good on you if you don’t care to file child support and work two jobs while you let your ex live his life without helping. But if my son was in his deadbeat dad’s custody and wasn’t paying for basic needs, CPS would come and take him away. So what’s the difference? How can you want to be a father/mother, but not feel any obligation in helping take care of basic needs of your kid? I work hard to give my son what he needs. But it’s ok if his dad doesn’t? So it’s not a perfect system on both sides. They would put me in jail in a heartbeat if I wasn’t taking care of my son. So why shouldn’t it apply to the other parent.
Everyone here at the end of the day despite how you and the person who helped create that child feel about each other, it is the CHILD here that suffers! I completely agree with the system being abused by narcissistic women who want nothing better than to destroy the fathers life and completely remove the father from that child’s life. My experience was that my child’s father killed himself in a auto accident before he was even born so I didn’t have the ‘luxury’ of ‘going after the father’ for child support. Yet I was treated like I did something wrong when I asked for help the times I did need the help! That also needs to change as well!

I agree I’m a man and I’ve had custody of my 2 kids for 13yrs and their mom owes me 13yrs of child support, I fought for 2 yrs for them since I made money from the oil field I paid everything… from state rides for her to see the kids to her attorney and every free benefit they gave came at my price.. in the end I got custody so for 2yrs I paid $2000 a month plus $1000 of health care.. so $3000 a month is what I paid .. and she couldn’t even comply with them giving her everything for free… it’s funny how they can find me but haven’t found her in 13yrs ..and since she wasn’t working they did it at minimum wage so she can’t even pay $315 a month.. and yet it was okay for me to pay $3000 system needs major work .. I’m great full in the end I got custody of them….

@ABKB, it is too much, If I was on child support I would have to pay $1700 a month for 3 kids……Do you even make that in one check? SO as a father how do you expect me to live at all? Car nope…….. Ill have to walk to work for the next 16 years. Own a home…..nope Ill have to live in my car for the next 16 years…….Vacation…….Food…..Clothes I guess I don’t need any of that according to you, guess you would rather me kill myself then? Since there is no joy in living broke. There should be a 50/50 split of the bills and care for the child. I think your comment is the extreme. I have two kids with a man who ran off to be with a whore he found on Facebook. When I left our marital home for my safety (Domestic Violence) by him and whore. I was given no choice but a divorce. After being a stay at home mom for years- I hustled and bustled to get a Job and get my kids into a living situation that was safe. He is flaky with his $600 a month child support while he lives on a 1/2 million dollar ranch. The kids health insurance I pay and he is suppose to reimburse 1/2; still months behind and its only $90. I think it can be a real shit sandwich for either parent who really cares about the kids. When I asked if he could help me with our daughters 6th grade band fees, I got told I had a stick in my ass. He takes all his visitation and Expects me to provide all clothing and wash it once returned dirty. Picks them up on Thursday night for dinner visit, but I am expected to feed them dinner before he gets them. So I am being a parent and he is being a flaky because he wan’t to be a 12 year old chasing P***Y. Its hard to be the parent trying to pay for everything. The system is not setup to help anyone but the abuser (male or female).
It may sound extreme to you but thats life for many men who pay. I have had the calculation done and thats what I pay without insurance. You want support and you deserve it, but YOU are making it work without him, I know its hard but what needs to be done is being done. I have three kids it does not take 1700 a month to support them. If I had to pay that much there is no point of working, I deserve happiness too as a father so why so many women have a issue with 50/50??? What if you’re DL is not being renewed for failure to pay child support and you don’t even have any children? You’re being charged from a town that’s an 8 hour drive that you haven’t been in in 25 plus years.
The Dallas County courts are a joke at best. They don’t listen or consider anything….they just believe the women.
what I find interesting is how they charge you for child support and then tack on insurance. I thought the bills should be split but these h*** put it all on the dads.

I know every situation is different and there are some amazing Dads that do all they can to provide for their children. However..not my ex-husband He and I together agreed to 325.00 monthly and we would split the cost of activities, school supplies and such. I wanted to be fair and understood that neither of us made alot of money. This worked until he met his new wife. Child support stopped completely and I had to take a second job. And my son’s activities were too expensive on my own. In the mean time, they planned an extravagant wedding and honeymoon and they planned and had 2 children and bought a home. It took 3 years for the AG to bring him to court where he told the judge that he only worked 15 hrs a week and stayed home with his new kids because thats what his wife wanted. His wife is the breadwinner. So as I watched in amazement…the judge proceded to LOWER his child support to 180.00 a month. ( I paid 210.00 just for our son’s last exam w/glasses!!!)
Having said that, before I get replys that I am just a jealous ex…not the case. I am in a happy loving relationship with a man who faithfully pays his child support to ex.and is happy to do it out of love for his children. Sees them every visitation allowed. Much respect to all the good and devoted Daddys and Moms that make it work for the CHILDREN’S sake.
20% is a bit absurd. If I didn’t have a child I would live in a 2 bedroom apartment and still eat the way I eat and pay my bills the way I pay them. I would also have more expendable income because both my partner and I would be working instead of just him. We survive rather well on just his income even with him paying support. If he didn’t pay child support and one mother wasn’t keeping his child from him and the other moving around and unstable the kids could be split between both homes equally. There isn’t a need for a custodial parent when child care could be split evenly between both homes. Except in cases where the child wasn’t wanted or whatever the case might be.
Men do not have a choice, A women decided to have a baby and the man has to help support, a women decided to not have a baby and get a abortion and a man has no choice still. As a women if you chose not to protect YOUR body how is that anyone else fault? Child support is flawed. I have three children and am happily married, it does not cost 20% of my income to support them. I estimate I would have to pay 1500 a month if I was on according to calculators, It cost about $600 a most, You cannot even calculator living as they live where I HAVE to live any way and would have the same place even if they where not there. The only real cost is food and clothes and $600 is what I spend and I consider this balling. So how does the state get to a 1500 figure? Like I said rubbish just a way for women to mess over men, If I was ever placed on I would pay as I have too, since I have much to lose but my wife knows it stops there. I am not going to pay you $1500 a month then help every other weekend, holidays and any other issues, you are on your own. Thankfully I was smart enough not to marry an AMERICAN gold digger as many are and my wife does not believe in that trash and would rather have my time and money then just my money. Word up guys doint marry AMERICAN women most are bitter and will just try and hurt you then work with you. The man needs a life too and he should not suffer taking so much of his income for something he had no choice to make. 321zt District Court Smith County Texas did not listen to evidence that my son had an inabilith to pay child support. It is WELL over 20%. In fact, they have it set at $1000 MORE than his ENTIRE income leaving him indigent and yet throwing him into jail. The entiee case was based on lies and corruption, perjury and accusations u founded. There were also tampering of documents and forgery within the case and Judges did nothing to those perpetrators. Everyone turns a blind eye to crimes committed within this case and NOT done by the father but other parties and representatives. All of this also overseen by members of the Child Support Division, Tyler, Texas. Do these people believe the false narratives they create or are they truly just that corrupt? I suggest a good bpok for them called “The Portrait of Dorian Gray”….

There’s school supplies, sports, school lunch accounts (which are hundreds of dollars a school year in elementary alone and only go up), there’s instruments for band, medical bills, braces, pool parties for their birthday, halloween costumes, allowances, and a million other things that go into raising children. Not to mention, children require a larger home to accommodate bedrooms and a reliable mode of transportation to transport the children. All of these things are what child support pays for. And to say 20% is a ridiculous amount, shows just how truly ignorant you are!

Facts: child support can be used for whatever a woman wants to use it for many MANY do not actually use it on the kids like you think. My figures come from ppl I know on it and those who receive it. Women use it to supplement their income to have the same status of living as if the man was actually still living there. He now has to provide for himself and her and the children as he receives NO support when he has the children during visitation. I support 50/50 – all the women call me ignorant for saying a man is a parent, not just a bank. I love my wife and my children; I am blessed I got it right the first time. Many women here are going through hell for who they chose to marry and need they need support. I am just saying you would have a better chance of giving 50/50 then trying get a person to live in a dog house so you can keep things the same when they are not.
So 50/50 that would mean the non-custodial parent pays half the rent half the car payment half the gas that goes into the car to take the kids to where they need to go half the insurance half the water bill have the electric bill half of everything half of school clothes half of school supplies half of shoes half of everything! Some people need to get out of calculator and do the math on that and then do the math on 20% of your income that you have to pay and see which one weighs out the best.

He picked him up Friday and the kid said he was cold at school. Where is your mother and why didn’t she buy a jacket for this school year????????????? O dad she went to the This weekend she Bahamas with her new man………….He does not even have the money to buy the boy a jacket and I had to lend him the money until this coming Friday. I have been on both ends of the stick. My ex never paid a cent no medical or bills he owes 250k my husband had his kids shy of 2days of 50/50 but his ex took him to court every two yrs for more 1000 month +insurance +med bills + clothes but we made it and he never missed a payment. Until he went To Iraq there was a mix up he missed one month, he received a letter he had 10 days or warrant was being issued. But I do agree abt child payment but I be ok with it if every penny had to be logged for adit every yr. I don’t think child support should be allowed for automobiles or house cause have to have those thing even without kids.

This isn’t true. My ex owes $36,500 and they don’t do anything to enforce him to pay. He still has his license, he has been to jail. He has property in his name and sold it. Even though I made the attorney general aware, they did nothing. Now after 5 years he started paying again. But they are taking money from his checks and not giving it to me. I hot payments weekly for a month and now as soon as they take their fee I get nothing else.
My ex wife owes me 22k in back child support. She has not exercised visitation in a year and a half, and has only exercised visitation twice in the last 5 years. Unfortunately, she games the system by sending a 25 dollar check every three months. The AG re-starts the process of filing paperwork every time one of these token checks is sent, and because the process is such a bureaucratic mess, the order to pay support is not enforced. There really needs to be a ceiling on the amount owed in child support, so that when the threshold is met, an arrest warrant is issued and enforced. Throwing the deadbeat parent in jail for 6 months ought to be a motivator and if that fails, perhaps the AG could assist the custodial parent in the legal process of revoking the non custodial parent’s rights.
For real!. My ex owes over 97,000 and has NEVER been to jail for it!!! They want me to come up with money to hire a lawyer and then I’m sure I’ll be losing still. He works under the table and claims he won’t ever give me a dime. I have even told him to buy a gas card or could even pay a bill to help but nope. It doesn’t make sense. I see counties putting people in jail and posting their pictures online but for some reason because my ex keeps moving then they say they have to keep sending letters first. They also want me to do all the investigating and find out new phone numbers and addresses. I was told if he owned a vehicle, the money could be taken if he sold it but of course that didn’t happen either. He chooses to do what he wants and not pay anything. The most saddest thing is how he is setting an example for his boys if they ever have kids. Hopefully I can teach them to do the right thing.

Just because one parent chooses to end the marriage without fault doesn’t mean the other parent should pay for everything. children should not be used as income streams for mothers who don’t honor their vows. If dad hasn’t committed a crime or broke the vows and Mom wants to leave then let her leave. Child support is all about Title IV D. If the mom leaves, she is not entitled to the same lifestyle a loyal husban and father provided. Yes the children will not have the same lifestyle either. If money is the issue then stay married and honor the vows. The husband should not be penalized. If Dad wants to be involved and contribute to the upbringing of his children, then mom and and evil court system should let him. 50/50 and no child support. If both were equal when the birth certificate SIGNED then then they are equal when the marriage status changes. These women should stop treating marriage like cars and getting rid of them because they don’t like them any more. Every Judge, lawyer and lawmaker that profits from this system should be held accountable and put their family under the chopping block. No fault divorce laws destroy families and good men. Children are scarred for life because the system is broken.
It’s very simple there should not be a custodial parent in most cases… Custody and everything that goes with it. (ie shelter, food , clothing, etc.) should be split 50/50 it is fair for everyone, and allows for both parents to be equally involved in the raising of their child.
That’s how you find out who’s the deadbeat parent, if one parent refuses to take care of their child responsibly for 50 % of their childhood, then they should be ordered to pay Support but then and only then.
As with any system there’s always a way to abuse it and the custodial parent has Upper hand, plus most people that aren’t together anymore are very vengeful And don’t do what’s in the child’s best Interest, they use it as a way to get back at their ex. It’s also known that father’s disproportionately do not get custody of their children.
That in itself makes it very unfair process.

We are grandparents raising 3 grandkids and hired a PI to find the dad and give the Attorney General and the police his address and where he worked and they still can’t find him. He owes us over 250,000 in chid support and insurance but no help at all

Child support should not exist anymore. Men shouldn’t have to pay for something they most likely never wanted. Women need to learn to take responsibility for their own bodies. If they have reproductive rights, so should men. This is a corrupt system.
I can see everyone’s point of view here! I am a custodial parent and fortunate to make a great living to support my daughter on my own. I feel I made choices to have one kid to adhere to my earnings, living situations etc. Her bio father is on child support and gives what he can and it’s not much but it’s something. I appreciate that and feel penny pinching him and not allowing him to have a sustainable life would be ugly of me and to no benefit to my daughter long term. I am in a long term relationship with my boyfriend who is a non custodial parent and not by choice. He would choose to have his daughter and not charge mom a cent. Unfortunately he had a stroke October 2019. He got out of the hospital November 2019 with right side paralyzation and was not able to read or speak well. He is going to therapy and working really hard to regain his functions. We called child support when he got out of the hospital to modify his child support and sent them numerous documents regarding his conditions and his inability to work. Child support sent a letter back stating he had no obligation. We were confused so we called the child support office and they stated no modification will be done because his daughter will turn 18 in June and by the time he goes to court he wouldn’t have any obligation to pay but just the arrears. So they’re taking on the full amount of child support instead of the modification of minimum wage which is about 4K additional monies. We tried speaking to his ex and she will not budge in forgiving the arrears or coming to some sort of agreement or middle amount. He is depressed that this has ruined his financials, credit and his relationship with his daughter. She lives 5 hours away due to mom moving for her husbands job. She had been away about 6 years and rarely brought her down to see dad and he had to incur additional expenses to go see her. She has 4 children from other fathers. Not to mention this woman keeps her entire paycheck (80k) as her husband makes over 250k per year and she has a business and several rental properties but yet she is harping in pennies in comparison while we are penny pinching it now as I try to pay my bills and his. The system is very flawed in not fighting to help him as a father especially as he was not a deadbeat l! I couldn’t imagine doing this to my ex!

n took it out on me as well. I owed $2501 in arrears. They’ve been garnishing my check for $5 a week now for the past 8 months. That comes to $160. My mom hasn’t seen a dime. They took my federal of $1067, my state of $231 and also my stimulus check of $1200. With my check garnishments tbat brought my arrears to $2341. After my income taxes and stimulus check were applied that brought it to $157 over the amount owed. I want to know why the state is getting my money and not my mom? She raised my children without any state assistance. She met my children’s needs and wants by working her butt off. The state hasn’t provided for my children so why are they getting my money? All of it should go to my mom who deserves it. The state should absolutely not get all that money for sitting their ass in a comfy chair and merely typing on a computer. No money came out of their pockets to provide for my children. So someone please tell me why this money isn’t going to my mom? You typed some papers big fuckin deal. My mom did everything and I believe she is entitled to every damn dime.

My daughter in laws ex owes more than 20,000 and recently they took extra from him and she now not only does not get it for 180 days, she also doesn’t get her regular pmt either! As the NCP, seems like its impossible to get ahead. Being paying child support for the majority of my military career. Just retired but still ain’t done yet. Made a few visits to the local Child Support office to get a pay report to see what the balance i owe after all the years of monthly payments. The lady tells me that my obligation date is coming up. Didn’t know what that meant at the time but I was happy to know what was. I got happy for minute but reality hit and it a course it did not happen. Moving on with life after that….. months later it came up again and i inquired what could possibly keep that from happening, the news i got surely pissed me off. The Attorney General sends out a letter to the CP about the obligation coming up that gets filled out and mail back so my obligation doesn’t get terminated before my child’s graduation. When you talk to the child support reps, they all are nice and friendly but at the same time, child services are f’ckn you behind your back. I just recently retired and a course i am not making that big money anymore but still getting paid for doing 20. So its time to get that modification done. I went to see a lawyer and that mofo wanted to charge me over 3K and make me responsible for the court fees. Wasn’t gonna have it. So i decided to go the cheaper way and go through the system. Put in my request for child support modification and finally after 6 months, i gotta legal action pending for modification but there is no court date set. Since it took this long to finally get a response, I can’t imagine how long till i get a court date. I am still paying my court ordered payment that was initiated even though its been months that my pay has substantially decreased. Did a calculation on the Ken Paxton Child Support Calculator, as (self employed) even though i am unemployed… I cant wait to see the look she’s gonna have on her face.

This is false my daughters mother is so far behind in child support my daughter is 20 and her mother still owes over 12000 in child support I contacted the attorney general and they said they do not put them in jail for failure to pay they try to give the parent a chance to catch up.
I have a comment. I paid child support to my ex-husband on our sons. I also paid for their meal accounts at school, clothing, cell phones, etc. I took my child support detail, plus all my other receipts to court, and a judge modified the order. In lieu of child support, I paid the above, so that the children would get their needs met vs my ex-husband spending their money. I might add that I had child custody reversed as well, where I retook custody of the children. Do the right thing. Provide for the children’s needs despite what they other parent does or doesn’t do. Go to court with all your evidence vs telling the rest of the world how you were screwed over. Because the rest of the world can’t help you. But the judge can.

thats what mine did. i filed against her and wound up losing custody of my daughter because of her bullcrap sobby stories to my daughter. she didnt want me to pick her up because my ex always said if you want, we can go look at puppies and get icecream. when it was my weekend, she started crying and said ” i dont want to go i need to see some puppies” them my ex would start an argument in front of people who later i recognized as welfare workers she hung around with. this went on off and on for a couple of years, and i got sick of it emotionally and signed off my parental rights. Before i did this, last time i seen my daughter, i was dropping her off and my ex and her new hubby tried to start an argument and brought something up. i replied to her and to my surprise my daughter said” daddy, mommy said you would say that” That was when i knew i was never going to win the battle . My daughter wouldnt talk to me afterwards. my ex filled her head with so much lies, she thought i was a horrible person. I tried to take her to court over all this. prosecuter said we dont care except that you keep paying your support. after 2 refused visitations, i retained an attorney thru legal aid and filed to relinquish my parental rights. my ex fought me but after 2 months, my attorney forced them to explain why, when my ex made it impossible for me to see my daughter. she didnt convince the judge,since i had recorded a couple of visitation tries. after about an hour, it was all over. yes i was deeply hurt knowing my daughter was brainwashed to dislike me, and now i wouldnt ever have a chance to watch her grow up, but how would i do it from a jail cell? if i were to be thrown in jail for getting angry because of her and her new hubbys crap? I would lose my job, then my home, and the car i was paying for. then i would be kept in jail for not paying support since my wages would dissapear from losing my job for being in jail!!!. how do you do that if you are in jail? I never missed a payment and i still had to go thru hell just to see my little daughter. I chose sanity and freedom over jailtime and misery.When i meet my maker, he will know i tried my best and in the end broke down emotionally from the torment of not getting to see my daughter.
