Yesterday, the sky was filled with fireworks to celebrate the 4th of July.
Unfortunately, a day later, it appears as though fireworks are also being lit in what is shaping up to be a long, bitter and very public divorce battle between Katie Holmes, 33, and couch jumping gold medalist hubby Tom Cruise, 50.
The celebrity news website Hollywoodlife.com reports that Holmes has requested an Emergent Application in New York City. The unexpected move means that the former Dawson’s Creek star is seeking temporary emergency relief, which typically includes child support and custody.
It also means that Cruise will have to hire a New York divorce lawyer, and that both he and Holmes will appear in open court on July 17 in front of Judge Matthew Cooper – an event that is sure to have family, friends, reporters, fans and people who have a compelling fascination to witness the domestic destruction of total strangers up-close-and-personal scrambling for a seat in the courtroom. Most likely, the mass of humanity will have to wait outside ala the O.J. Simpson trial. One winces at what the T-shirt vendors will be hawking.
Celebrity divorce attorney Vikki Ziegler, author of The Pre-Marital Planner, spoke with Hollywoodlife.com to explain the thinking behind Holmes’ strategy.
“Tom is probably asking for parenting time,” Ziegler noted. “She’s asking for it to be reviewed on an expedited basis to protect the child, Suri. She’s saying, ‘I want this case tried in New York, I want temporary full custody, I want child support and I may want my legal bills paid as well.’ Katie doesn’t anticipate Tom cooperating, and there have been rumors that he’s going to file in California and argue that litigation should be there rather than New York…It’s super-aggressive for Katie to have taken these steps. It suggests that there’s going to be a contentious divorce battle to come.”
Ziegler also added that it’s unusual for a celebrity divorce to make its way to open court, with most spouses preferring to settle their matter as far away from the public eye as possible.
No doubt, this won’t be the first unusual or unexpected twist in this divorce saga. This is just the trailer.
