Brad Micklin, a family lawyer in Nutley, answers:
You can prepare your own agreement, but I typically recommend against it. The laws surrounding issues such as child custody, support, and equitable distribution are complex. The rules of court and rules of evidence are oftentimes contrary to what would be considered common sense. When people prepare their own agreement without the assistance of, or at the very least, review by, counsel, issues often come up that were not contemplated by the agreement which require frequent trips back to court. Moreover, going through a divorce is often an extremely stressful and emotional event in someone’s life that can cloud one’s judgment and hamper one’s ability to make decisions that will be best in the long run for themselves and their families. It is important that you retain an experienced matrimonial attorney who will explain to you what your rights and potential obligations are, zealously advocate for you, and protect your interests in court.
