When a married couple is deciding to be divorced, what they will do is they will first discuss where the kids are going to live. It’s usually done in a conversation between the two parents, depending on the ages of the children. Generally, the parents have an idea as to what their ideal parenting situation would be after they separate. If they’re able to enter into a consent order, then they’re able to say, “Well, the child will primarily live with you or with me,” and then reduce that to writing.
